TERMS OF USE

Kosovo’s Law No. 06/L-082 governs personal-data protection, while Law No. 04/L-094 governs information-society services. ([Gazeta Zyrtare e Republikës së Kosovës][2])

These Terms of Use govern access to and use of the website ceed-biz.net, referred to as “CEED Biz,” the “Website,” or the “Platform.”

The Website is operated by CEED Kosovo, located in Pristina, Kosovo, referred to in these Terms as “CEED Kosovo,” “CEED,” “we,” “us,” or “our.”

By visiting the Website, creating an account, submitting information, applying for membership, publishing content, or otherwise using the Platform, you confirm that you have read, understood, and agreed to these Terms of Use.

If you do not agree with these Terms, you must not use the Website.

1. Purpose of CEED Biz

CEED Biz is a professional and business networking platform designed to connect entrepreneurs, companies, mentors, experts, professionals, and members of the CEED community.

The Platform may allow users to:

•  create and manage professional or business profiles;
•  view member and mentor profiles;
•  publish and view business offers;
•  publish and view requests for services, cooperation, or opportunities;
•  communicate with other users;
•  apply for CEED membership;
•  learn about CEED programs, projects, events, and activities;
•  access news, resources, and business-related information;
•  receive newsletters and other communications where they have opted in; and
•  discover potential business, mentoring, or collaboration opportunities.

CEED Biz primarily provides information, visibility, networking, and communication tools. Unless expressly stated otherwise, CEED Kosovo is not the seller, supplier, employer, agent, broker, or contracting party in arrangements made between users.

 2. Eligibility

The Platform is not intended or offered to children under the age of 13.

When using the Website on behalf of a company, organization, or other legal entity, you confirm that:

1. you are authorized to represent that entity;
2. you have authority to accept these Terms on its behalf; and
3. the information you provide about that entity is accurate.

CEED Kosovo may restrict access to certain features to approved members, mentors, companies, partners, employees, administrators, or other authorized users.

 3. User accounts

Certain parts of CEED Biz may require users to register for an account.

When creating or using an account, you agree to:

•  provide accurate, complete, and current information;
•  update your information when it changes;
•  create only one account unless CEED Kosovo authorizes otherwise;
•  use your own identity or an identity you are legally authorized to represent;
•  keep your login credentials confidential;
•  use a strong and secure password;
•  prevent unauthorized access to your account; and
•  notify CEED Kosovo promptly if you suspect unauthorized use of your account.

You are responsible for activity carried out through your account, except where unauthorized activity results directly from a security failure for which CEED Kosovo is legally responsible.

You must not sell, transfer, rent, share, or assign your account to another person without our prior written permission.

CEED Kosovo may request additional information to verify your identity, company, professional role, membership status, or authority to represent an organization.

 4. Information provided by users

When registering, applying for membership, completing a profile, contacting CEED Kosovo, or using the Platform, users may be asked to provide information including:

•  name or username;
•  telephone number;
•  email address;
•  mailing or company address;
•  job title;
•  age or age-related confirmation;
•  company and professional information;
•  profile information;
•  account password; and
•  other information voluntarily submitted through the Website.

The collection and use of personal information are further explained in the CEED Biz Privacy Policy.

Users are responsible for ensuring that the information they provide is accurate, lawful, and not misleading.

 5. Membership applications

Users may submit membership requests through CEED Biz.

Submitting a membership application does not automatically create CEED membership and does not guarantee acceptance into any CEED membership plan, program, project, service, or event.

CEED Kosovo may:

•  review submitted applications;
•  contact applicants for further information;
•  verify information submitted by an applicant;
•  request supporting documents;
•  accept or reject an application;
•  recommend a different membership category; or
•  impose additional eligibility or participation conditions.

Specific memberships, programs, projects, events, or services may be governed by separate agreements, payment terms, participation rules, or other conditions.

Where separate terms apply, those specific terms will supplement these Terms of Use. If there is a conflict, the specific terms will take priority in relation to that particular membership, program, project, event, or service.

 6. Member and mentor profiles

CEED Biz may display profiles of members, mentors, companies, experts, and other professionals.

Profiles may contain information such as:

•  names and profile photographs;
•  company names and logos;
•  professional roles and job titles;
•  skills and areas of expertise;
•  mentorship fields;
•  company descriptions;
•  business sectors;
•  countries and locations;
•  contact information;
•  professional experience;
•  website and social-media links; and
•  membership or participation information.

Users are responsible for keeping their profile information accurate and current.

The appearance of a person, mentor, company, product, service, or opportunity on CEED Biz does not mean that CEED Kosovo guarantees or independently certifies every qualification, statement, product, service, result, or claim associated with that profile.

CEED Kosovo may review, format, edit, approve, reject, temporarily hide, or remove profile information where reasonably necessary to:

•  operate the Website;
•  correct formatting or technical issues;
•  protect users;
•  investigate complaints;
•  comply with legal requirements; or
•  enforce these Terms.

We will not intentionally change the substantive meaning of user content unless the user has authorized us to do so or the change is required by law.

 7. Business offers and requests

Authorized users may be able to publish business offers, discounts, promotions, services, products, requests, collaboration opportunities, or other commercial information.

The user who publishes an offer or request is solely responsible for:

•  the accuracy of the information;
•  the legality of the offer, service, or opportunity;
•  the availability of anything offered;
•  prices and applicable taxes;
•  delivery or performance conditions;
•  warranties and representations;
•  obtaining necessary permits or approvals;
•  complying with advertising and consumer-protection requirements; and
•  fulfilling agreements made with other users.

Unless expressly confirmed by CEED Kosovo in writing, CEED Kosovo:

•  does not sell the products or services published by users;
•  does not process payments between users;
•  does not guarantee the availability or quality of an offer;
•  does not guarantee that information published by a user is accurate;
•  is not a party to agreements between users; and
•  is not responsible for non-payment, non-delivery, non-performance, or disputes between users.

Users must conduct their own checks before entering into a business relationship, transaction, mentorship arrangement, partnership, investment, employment arrangement, or other commitment.

 8. No online payments

CEED Biz does not currently allow users to complete purchases or payments directly through the Website.

Where a user, company, mentor, or other third party offers a paid product or service, any payment arrangement will take place separately between the relevant parties unless CEED Kosovo expressly states otherwise.

CEED Kosovo is not responsible for external payment methods, invoices, payment disputes, refunds, or transactions made outside the Website.

Where CEED Kosovo later introduces online payments, additional payment and cancellation terms may apply.

 9. Communications between users

The Platform may permit users to send messages, inquiries, requests, or other communications.

Communication tools may only be used for legitimate professional, networking, mentoring, and business purposes.

You must not use the Platform to send:

•  spam or unsolicited mass messages;
•  fraudulent or misleading proposals;
•  abusive, threatening, harassing, or discriminatory content;
•  unlawful advertising or marketing messages;
•  malicious links, harmful files, malware, or computer viruses;
•  content that infringes another person’s rights; or
•  messages unrelated to the legitimate purpose of the Platform.

Users should exercise care before sharing confidential, financial, commercially sensitive, or personal information with another user.

CEED Kosovo and its authorized administrators or service providers may access, process, or review Platform communications where reasonably necessary to:

•  operate or maintain the Platform;
•  provide technical support;
•  investigate reported misconduct;
•  prevent fraud or security threats;
•  enforce these Terms; or
•  comply with legal obligations.

 10. Mentorship and professional information

Mentors, members, and other users may provide business information, opinions, recommendations, or professional guidance through the Platform.

Unless a separate written agreement expressly states otherwise, information obtained through CEED Biz is provided for general informational and professional-development purposes.

It does not constitute guaranteed:

•  legal advice;
•  tax advice;
•  accounting advice;
•  financial or investment advice;
•  medical advice;
•  employment advice; or
•  other regulated professional advice.

Users remain responsible for their own professional and business decisions.

CEED Kosovo does not guarantee that:

•  a particular mentor will be available;
•  a mentor or member will respond to a request;
•  a connection will lead to a business relationship;
•  advice will produce a particular outcome;
•  participation will result in funding, investment, increased revenue, or business growth; or
•  a particular collaboration will be successful.

 11. User content

“User Content” means any information, text, image, photograph, logo, document, offer, request, review, profile, comment, message, link, or other material submitted to the Platform by a user.

You retain ownership of User Content that you own.

By submitting User Content to CEED Biz, you grant CEED Kosovo a non-exclusive, worldwide, royalty-free licence to:

 host and store the content;

•  reproduce and display it on the Platform;
•  format or resize it for technical and design purposes;
•  publish it as part of your profile, offer, request, or submission;
•  use it to operate and promote CEED Biz; and
•  use it to communicate about the CEED community, members, mentors, programs, projects, and opportunities.

This licence applies only to the extent reasonably necessary to operate, administer, and promote the Platform.

You confirm that:

1. you own the content or have permission to submit it;
2. the content is accurate and not materially misleading;
3. publication does not violate another person’s rights;
4. the content does not contain confidential information that you are prohibited from disclosing; and
5. the content complies with applicable law and these Terms.

You may request the removal of your content by contacting CEED Kosovo. Certain information may remain in backups, administrative records, legal records, or archived copies where retention is necessary or legally permitted.

 12. Advertising and promotional content

CEED Biz may display advertisements, sponsored material, promotional content, member offers, partner information, donor information, or other commercial communications.

Advertising or promotional material should be clearly distinguishable where required by applicable law.

The appearance of advertising or sponsored material does not necessarily mean that CEED Kosovo recommends or guarantees the advertiser, product, service, offer, or claim.

Advertisers and users publishing promotional information are responsible for ensuring that their content is:

•  accurate;
•  lawful;
•  not misleading;
•  properly authorized; and
•  compliant with applicable advertising, intellectual-property, and consumer-protection requirements.

CEED Kosovo may reject or remove advertising or promotional content that it considers inappropriate, misleading, unlawful, harmful, or inconsistent with the purpose of the Platform.

 13. Facebook Pixel and similar technologies

The Website may use the Meta/Facebook Pixel or similar technologies.

These technologies may collect information about visits, browser activity, device information, page interactions, and actions taken on the Website.

According to the current Platform configuration, CEED Kosovo does not use this information to conduct retargeting advertising. However, information may still be processed for purposes such as advertising measurement, campaign performance, attribution, security, or technical operation.

Further information about tracking technologies, cookies, consent options, and third-party processing must be provided in the Privacy Policy and Cookie Policy.

Where required by law, non-essential tracking technologies should not be activated until the user has provided valid consent.

 14. Email communications and newsletters

Users may voluntarily opt in to receive newsletters, announcements, invitations, updates, business opportunities, and other communications from CEED Kosovo.

Users may withdraw their consent or unsubscribe from marketing emails at any time by:

•  using an unsubscribe link included in the communication; or
•  contacting CEED Kosovo at [info@ceed-kosovo.org](mailto:info@ceed-kosovo.org).

Unsubscribing from promotional communications may not stop essential account, membership, security, administrative, or service-related messages.

CEED Kosovo must not send marketing communications to users who have not provided the necessary consent or where another lawful basis is not available.

 15. Prohibited activities

You must not use the Website to:

•  violate any applicable law or regulation;
•  impersonate another person or organization;
•  create a false or misleading account;
•  provide materially false information;
•  publish fraudulent or deceptive offers;
•  infringe copyright, trademarks, privacy, confidentiality, or other rights;
•  distribute unlawful or harmful content;
•  harass, threaten, exploit, or discriminate against another person;
•  collect user information without an appropriate lawful basis;
•  send unsolicited bulk communications;
•  scrape or systematically extract Platform information without permission;
•  create a competing database from information found on the Website;
•  use bots or automated systems to access the Platform without authorization;
•  introduce malware, viruses, ransomware, or harmful code;
•  attempt to access another user’s account;
•  attempt to access restricted administrative systems;
•  interfere with the Website’s security or availability;
•  bypass access controls or technical restrictions;
•  manipulate ratings, reviews, search results, or engagement;
•  use the Website for unlawful recruitment or financial schemes; or
•  engage in conduct that could harm CEED Kosovo, its users, partners, donors, service providers, or reputation.

 16. Reviews, ratings, and feedback

Where CEED Biz permits reviews, ratings, comments, or feedback, users must submit honest information based on genuine experience.

Reviews or ratings must not be:

•  purchased or exchanged;
•  artificially generated;
•  submitted to unfairly harm a competitor;
•  defamatory, abusive, or discriminatory;
•  unrelated to the relevant service or experience; or
•  based on knowingly false information.

CEED Kosovo may remove or restrict content that appears to violate these Terms, but it is not obligated to verify every review before it is published.

Suggestions and general feedback voluntarily submitted to CEED Kosovo may be used to improve the Platform without payment or compensation, provided that such use does not violate the user’s intellectual-property or privacy rights.

 17. Intellectual property belonging to CEED Kosovo

The Website and its original content may include:

•  software and source code;
•  website design and layout;
•  databases;
•  text and graphics;
•  photographs and videos;
•  documents and resources;
•  CEED names, logos, and trademarks; and
•  other content owned by or licensed to CEED Kosovo.

These materials are protected by applicable intellectual-property laws.

CEED Kosovo grants users a limited, revocable, non-exclusive, non-transferable right to use the Website for legitimate informational, professional, networking, and business purposes.

Without prior written permission, users must not:

•  copy or republish substantial parts of the Website;
•  reproduce CEED logos or trademarks;
•  commercially exploit Platform content;
•  sell or sublicense access to the Platform;
•  create derivative services using Platform data;
•  reverse engineer the Platform, except where expressly permitted by law; or
•  falsely suggest that CEED Kosovo endorses a person, business, product, or service.

 18. Intellectual-property complaints

A person who believes that content on CEED Biz infringes copyright, trademark, or another intellectual-property right may contact CEED Kosovo.

The complaint should include:

•  the complainant’s name and contact information;
•  identification of the protected work or right;
•  identification and location of the allegedly infringing content;
•  an explanation of the alleged infringement;
•  evidence of ownership or authority to represent the rights holder; and
•  confirmation that the information provided is accurate.

CEED Kosovo may temporarily restrict or remove disputed content while reviewing a complaint.

 19. Third-party websites and services

CEED Biz may contain links to third-party websites, social-media platforms, services, advertisements, tools, or resources.

Third-party services are operated independently and may have their own terms, privacy policies, cookie practices, and security measures.

CEED Kosovo does not control and is not responsible for:

•  the availability of third-party services;
•  their content or accuracy;
•  their privacy or security practices;
•  their products or services; or
•  transactions completed through them.

Users access third-party services at their own discretion and should review the applicable third-party terms and policies.

 20. Platform availability and changes

CEED Kosovo aims to keep the Platform available and functioning properly but does not guarantee uninterrupted or error-free access.

The Website may occasionally be unavailable because of:

•  maintenance;
•  technical problems;
•  software updates;
•  security incidents;
•  hosting or internet failures;
•  third-party service failures; or
•  circumstances outside CEED Kosovo’s reasonable control.

CEED Kosovo may modify, add, remove, suspend, or discontinue a part of the Platform where reasonably necessary.

We may also change eligibility requirements, features, layouts, membership options, or content without guaranteeing that every existing feature will remain permanently available.

 21. Moderation, suspension, and termination

CEED Kosovo may investigate suspected misuse of the Platform.

Where reasonably necessary, we may:

•  request clarification or supporting information;
•  reject or remove content;
•  restrict access to a feature;
•  issue a warning;
•  temporarily suspend an account;
•  permanently terminate an account;
•  preserve relevant information;
•  notify affected users; or
•  report unlawful conduct to competent authorities.

Immediate action may be taken without advance notice where CEED Kosovo reasonably believes that an account, activity, or piece of content creates:

•  a security risk;
•  a fraud risk;
•  a legal or regulatory risk;
•  a risk of harm to another person; or
•  a significant risk to the Platform.

Users may stop using CEED Biz at any time and may request account closure by contacting CEED Kosovo.

Account closure or termination does not affect rights or obligations that arose before the account was closed.

 22. Disclaimer of warranties

To the fullest extent permitted by applicable law, CEED Biz is provided on an “as available” basis.

CEED Kosovo does not guarantee that:

•  the Website will always be available;
•  the Website will be completely free from errors or harmful components;
•  all user-submitted information will be accurate;
•  every user is who they claim to be;
•  offers or opportunities will remain available;
•  users will respond to messages;
•  a particular business, mentor, member, product, or service will meet a user’s expectations; or
•  use of the Platform will produce a particular commercial or professional result.

Nothing in these Terms excludes guarantees, rights, or remedies that cannot lawfully be excluded.

 23. Limitation of liability

To the fullest extent permitted by applicable law, CEED Kosovo will not be liable for indirect, incidental, special, consequential, or purely economic loss arising from:

•  use or inability to use the Platform;
•  reliance on information submitted by another user;
•  business decisions made through the Platform;
•  transactions or arrangements between users;
•  unauthorized account access not caused by CEED Kosovo;
•  third-party websites or services;
•  interruption or loss of Platform availability; or
•  content removed or restricted in accordance with these Terms.

CEED Kosovo’s liability will not be excluded or limited where such exclusion or limitation is prohibited by law, including liability arising from intentional misconduct, fraud, or other liability that cannot legally be restricted.

 24. User responsibility for violations

You are responsible for losses, claims, expenses, or liabilities that result directly from:

•  your unlawful use of the Platform;
•  your violation of these Terms;
•  content you publish without the necessary rights;
•  fraudulent or misleading information you provide; or
•  your violation of another person’s rights.

This section does not require a user to compensate CEED Kosovo for losses caused by CEED Kosovo’s own unlawful conduct or negligence where such limitation would be prohibited by law.

 25. Privacy and personal data

CEED Kosovo processes personal data in accordance with applicable data-protection requirements and the CEED Biz Privacy Policy.

The Privacy Policy should explain, among other matters:

•  what information is collected;
•  why it is collected;
•  the lawful basis for processing;
•  how long it is retained;
•  who receives or processes it;
•  whether information is transferred internationally;
•  how cookies and the Facebook Pixel are used;
•  how users may exercise their rights; and
•  how users may contact CEED Kosovo regarding personal data.

These Terms of Use do not replace the Privacy Policy or Cookie Policy.

 26. Changes to these Terms

CEED Kosovo may update these Terms where necessary to reflect:

•  changes to the Platform;
•  new features or services;
•  legal or regulatory requirements;
•  security considerations; or
•  changes in CEED Kosovo’s activities.

The revised Terms will be published on the Website with an updated effective date.

Where changes are significant, CEED Kosovo may provide additional notice through the Website, by email, or through the user’s account.

Continued use of the Platform after updated Terms become effective means that the user accepts the revised Terms, except where applicable law requires a different form of consent.

 27. Governing law and disputes

These Terms are governed by the laws applicable in the Republic of Kosovo.

Users and CEED Kosovo should first attempt to resolve complaints or disputes through good-faith communication.

Where a dispute cannot be resolved informally, it may be submitted to the competent courts of the Republic of Kosovo, subject to any mandatory rights or jurisdiction rules that apply to the user.

 28. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be limited or removed only to the extent necessary.

The remaining provisions will continue to apply.

 29. No waiver

If CEED Kosovo does not immediately enforce a provision of these Terms, this does not mean that CEED Kosovo has waived the right to enforce it later.

 30. Entire agreement

These Terms, together with the Privacy Policy, Cookie Policy, and any specific terms applicable to a particular membership, program, project, or service, form the agreement between the user and CEED Kosovo concerning use of CEED Biz.
